TERMS AND CONDITIONS
THE GREAT DAY ONLINE CHOIR
THESE TERMS AND CONDITION RELATE TO TO PERIOD WHEN THE CHOIR IS RUNNING ONLINE DUE TO THE CORONAVIRUS.

The Great Day Online Choir is has replaced both The Great Day Choir Main Sessions (Bath, Mangotsfield and Knowle) and Bella Mamas, for the foreseeable future and until we are informed that social gathering are able to proceed in regular venues.

Health Declaration
Members are assumed to be medically fit to undertake the activities of the choir. Anything which a Member is unsure of should be discussed with the Musical Director before seeking membership.

Sessions and Membership
2.1 The Great Day Online Choir will operate weekly as set out in the publicity given to members. Session dates will be published for each month and reviewed each month according to latest social guidance.
2.2 The Great Day Online Choir operates on a payment up front system. Once paid, Membership fees for a block or a month are non-refundable or transferable to future session blocks. Pay-as-you go is not accepted. Part payment of blocks is not accepted unless it is the first payment, when a member commences with the choir, if starting part way through a block.
2.3 If paying monthly or for a session block, the Member will be charged for any sessions they do not attend. If a scheduled session has to be cancelled, the Member will receive a full refund for the session fee.
2.4 The Member is entitled to attend any sessions paid for.
2.5 If The Great Day Online Choir stops the sessions, then the Member will receive a full refund for the sessions not yet given.
2.6 You have the right to cancel the Agreement within 14 days from the Start of the Agreement without giving any reason but you must notify us in writing if you wish to do so within the 14 day period. You may email at info@thegreatdaychoir.co.uk. The cancellation period will expire after 14 days from the day you accept the terms. To meet the cancellation deadline, it is sufficient if you send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
2.7 In case of dispute you must show that you cancelled the Agreement in accordance with the cancellation terms.
2.8 If you cancel your Membership within the 14 day period we will refund you the fees paid for the remainder of month/ session block, no later than 14 days after the day on which we are informed about your decision to cancel, less the cost of the sessions to the date of the cancellation.
2.9 After the 14 cancellation period, you may terminate your Membership at any time by emailing info@thegreatdaychoir.co.uk. Your membership will end with immediate effect. Refunds will not be given for the remainder of the month or the session block. Any amounts outstanding must be paid in full and in no more than 30 days.
2.10 You may interrupt your Membership for any period for exceptional reasons (to be agreed with The Great Day Choir), by emailing info@thegreatdaychoir.co.uk. During this time, your access to the members facebook group and website members area will be de-activated.
2.11 All lyrics sheets will be made available to members online.
2.12 On becoming a Member of The Great Day Online Choir, you will be eligible to join the closed Members Facebook Group for the choir. You will also be added to the email mailing list to receive information about choir activities.
2.13 To access the online choir members are required to have access to a device eg. Smart phone, tablet, laptop, PC with a microphone and camera, and an operating system to be able to download the application Zoom.
2.14 The Great Day Online Choir will supply Zoom meeting access codes to members, no later than Sunday evening for sessions of the following week.

Code of Conduct

3.1 The Great Day Online Choir aims to be a positive and safe environment for all its Members. In order to do this, we must ensure acceptable standards of behaviours from all its Members.

3.2 Members are asked, where possible, to be punctual to the session. This allows them to participate in the vocal warm up which is essential for good vocal health before singing.
3.3 All Members should be co-operative and respectful towards each other and Staff. Any form of negative behaviour, whether written or verbal towards others including The Great Day Online Choir Members and Staff or to the rehearsal/ performance environment Staff or audience will lead to cancellation of Membership without refund.
3.4 We uphold an equal opportunities environment.
3.5 Social Media groups linked to The Great Day Online Choir must comply with the Malicious Communications Act 1988 and The Communications Act 2003.
3.6 Members should understand clearly that The Great Day Online Choir cannot be held financially responsible for damage caused by misconduct.


Health and Safety
4.1 The Great Day Choir is not responsible for damage to person or personal belongs whilst attending sessions and before and after sessions.

Our Rights
5.1 We may terminate this Agreement and your The Great Day Choir Membership with immediate effect if you do not pay any applicable fees or monthly Membership amount when it falls due, by giving written notice.
5.2 We may terminate this Agreement and cancel your The Great Choir Membership with immediate effect if you breach any of the Code of Conduct outlined in this Agreement, with written notice. In this event you will no longer be able to access your downloads and you will not receive a refund.
5.3 We may communicate The Great Day Choir related information to you by email, SMS or Facebook.
5.4 We will notify you of any changes to these terms and conditions.

Your Obligations
6.1 You agree to pay fees three days prior to the first date of the session block or the agreed date of the month when paying monthly, typically the date of the first session you commenced singing with the choir.
6.2 Where applicable, you agree to maintain a standing order with your bank for the monthly session fees.
6.3 Where applicable, session block fees are due three days prior to the first date of the block.
6.4 You confirm that you are at least 18 years old.
6.5 You must use The Great Day Choir download and music in the proper manner and must consult The Great Day Choir if you are unsure.
6.6 Downloads which can be accessed as a Member of The Great Day Choir, are for use in this choir only and must not be shared with any third parties without first seeking permission from The Great Day Choir.
6.7 You consent to incidental inclusion in marketing photographs that we make take from time to time.
6.8 You agree to inform us immediately of any changes to your personal details including contact information by emailing info@thegreatdaychoir.co.uk

Communication between the Parties
For the purposes of this Agreement written notice must be given on paper or by email.

Other Clauses
8.1 Children under the age of 18 years brought to The Great Day Online Choir are solely the responsibility of the Parent/ Carer.
8.2 You will be asked consent for any photographic, motion picture, electronic (video) images and sound and video recordings may be taken of all the Members and used for advertising and marketing purposes in relation to The Great Day Choir.
8.3 You may opt out of email and SMS communications that we send but if you do, we cannot be held responsible for any loss incurred by you not receiving The Great Day Choir related communications.

Data Protection Act
Personal and private information held by The Great Day Choir for the purpose of communication such as email addresses and telephone numbers will not be passed to external bodies, organisations, third parties or other Members.

Payment methods:
10.1 Session Block payments: Payment must be received and processed three days before the first advertised session of the block. If full payment is not received for the block before the first date, a Member does not have the right to attend and will be deactivated from accessing downloads.


10.2 Monthly payments: These payments must be set up by BACS before the start of the first paying session you wish to join/ the first session of a block and will continue monthly throughout the year until the Member wishes to leave The Great Day Choir.


10.3 Payments can be made online by debit or credit card via BACS. The details are: Sort Code 11-04-30 Account number: 11657262 Name: Mrs B Morgan. Cheques are accepted and must be made payable to ‘Mrs B. Morgan’ and with the Members name on the reverse and posted to 23 Wakeford Way Warmley BS30 5HU Bristol UK. Whilst we are operating as an online choir, we will not accept cash payment.

If any of the terms of this Agreement are invalid, unenforceable or illegal the remaining terms can still be enforced.
This Agreement is governed by the law of England and Wales.
You should print a copy of this agreement for your future reference.

Amendments
The Great Day Choir reserves the right to amend these terms and conditions at any time without notice.
